Scottish golfer Colin Montgomerie had a narrow escape when a speeding charge was dropped against him after the police had made a mistake.
Montgomerie was caught driving a Lexus on the M80 at Dunipace, near Falkirk by a mobile speed camera . It was alleged that the car was travelling at 88 mph on a 70 mph road on 24 February.
As police officers in his home town of Surrey had not served him with a summons, the trial at Falkirk District Court had to be abandoned.
In Scotland, the law requires the prosecution to serve the accused with a summons within six months from the date of an alleged motoring offence.
If this isnt done the case becomes time barred and fails.
This is the second time Montgomerie has escaped being prosecuted for speeding in three years.
The first time was in September 2004. He was accused of driving at 96 mph on the A3 in Surrey. However the case did not proceed as one of the arresting officers failed to attend court for the hearing.
